The Canadian Anti-Spam Law takes effect on July 1, and has a global impact on businesses of all sizes who market to anyone in Canada through commercial electronic messages (CEMs) without receiving prior proof of consent.

CASL is simply a way for all businesses to promote e-commerce while reducing the amount of spam, spyware/malware, phishing and identity theft, says email marketing solutions provider CakeMail.

The penalties for not complying with CASL can run as high as $10 million and result in personal liability for company officers and directors.

“So it’s simple. If you want to email someone, you need permission,” said CakeMail Director of Deliverability Kevin Huxham. “People receiving your emails must give consent, be able to unsubscribe and you must be able to prove consent was given.”
